1. What is the purpose of the Privacy Statement?

Sobinco NV attaches great importance to protecting your privacy and personal data. We use your personal data solely in accordance with the Privacy Protection Act and other relevant legal regulations that are in effect. Any reference in this Privacy Statement to the Privacy Protection Act is a reference to the Belgian Act of 8 December 1992 for the protection of privacy with respect to the processing of personal data. Any reference to the Regulation is a reference to the EU Regulation of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.

With this Privacy Statement, Sobinco NV wants to inform you about the possible processing operations with respect to these data and your rights. By using our platform/website/application, you explicitly grant your consent to possible processing operations performed by Sobinco NV. 
This Privacy Statement may be subject to adjustments and changes in future. It is your responsibility to consult this document on a regular basis. Any substantial changes will always be clearly communicated on the Sobinco NV platform.

Sobinco NV undertakes to process only data that are relevant and necessary for the purposes for which they have been collected. The following categories of personal data may be processed by Sobinco NV:

4. What is my personal data used for?

Sobinco NV collects personal data in order to offer you a secure, optimal and personalised user experience. The collection of personal data becomes more extensive as you make more intensive use of the platform/website/application and our online services.

Data processing is essential for the functioning of the platform/website/application and the associated services. The processing is carried out solely for the following specific purposes:

  • Allowing you access to your user profile
  • Offering and improving our general and personalised services: including invoicing, providing information, newsletters and offers that may be useful and/or necessary for you, collecting and processing user reviews and providing support
  • Offering and improving the delivered products: personalised and specific products based on the provided information and data 
  • Detecting and offering protection against fraud, errors and/or criminal behaviour
  • Marketing purposes

When you visit the platform/website/application of Sobinco NV, some data are collected for statistical purposes. Such data are necessary for optimising the use of our platform/website/application. This includes the following: IP address, probable location, time and date of access and which pages were visited. When you visit the platform/website/application of Sobinco NV, you declare that you consent to this data collection intended for the statistical purposes described above.
It is always the User who provides the personal data to Sobinco NV and in this way he or she may exercise a certain degree of control. If certain data are incomplete or apparently incorrect, Sobinco NV reserves the right to temporarily or permanently defer certain expected actions. 
The personal data are solely processed for internal use within Sobinco NV.
We can therefore assure you that personal data will not be sold, transferred or communicated to third parties associated with us. Sobinco NV has taken all possible legal and technical precautions to avoid unauthorised access and use.

5. We also use cookies!

6. What are my rights?

6.1 Guarantee of lawful and secure processing of personal data

Sobinco NV always processes your personal data in an honest and lawful manner. This implies the following guarantees:

  • Personal data are solely processed in accordance with the specified and legitimate purposes outlined in this Privacy Statement
  • Personal data are solely processed insofar as this is sufficient, relevant and not excessive
  • Personal data are only stored for as long as this is necessary to achieve the specified and legitimate purposes outlined in this Privacy Statement

The necessary technical and security measures have been taken to minimise the risks of unlawful access to or processing of the personal data. In case of a breach of its IT systems, Sobinco NV will immediately take all possible measures to limit the damage to a minimum.

6.2 Right to access/rectify/erase your personal data

Upon proof of your identity as a User, you have the right to receive a definite answer from Sobinco NV about whether or not your personal data are being processed. If Sobinco NV processes your data, you also have right of access to the collected personal data. If you wish to exercise your right of access, Sobinco NV will comply with this within one (1) month of receiving the request. The request may be sent via registered mail or via email to privacy@sobinco.com.

Inaccurate or incomplete personal data may be rectified at any time. It is primarily the User’s responsibility to rectify inaccuracies and omissions in his or her personal data. You may also exercise your right to rectification by providing an additional statement to Sobinco NV. In this case, Sobinco NV will comply with this within one (1) month of receiving the additional statement. 
Moreover, you have the right to request your personal data to be erased by us without unreasonable delay. You may only invoke this right to be forgotten in the following cases:

  • If the personal data are no longer necessary for the purposes for which they were originally collected
  • If the personal data had been collected based on obtained consent and there is no other legal basis for the processing 
  • If an objection is submitted against the processing and there are no prevailing compelling legitimate grounds for the processing
  • If the personal data have been processed unlawfully 
  • If the personal data are required to be deleted in accordance with a legal obligation

Sobinco NV will assess whether one of the aforementioned cases exist.

6.3 Right to limit/object to the processing of your personal data

The User has the right to obtain restriction of processing of his or her personal data:

  • During the period of time needed by Sobinco NV to verify the accuracy of the personal data, in the event of any dispute 
  • If the data processing is unlawful and the User requests a restriction of processing instead of the erasure of the personal data 
  • If Sobinco NV no longer requires the personal data of the User for the processing purposes and the User requires the personal data in connection with a legal claim
  • During the period of time needed by Sobinco NV to assess whether there are grounds for the erasure of the personal data

In addition, the User has the right to object to the processing of his or her personal data at all times. In this case, Sobinco NV will stop processing the User’s personal data, unless it can demonstrate compelling legitimate grounds for the processing of your personal data that outweigh the User’s right to object.
If the User wishes to exercise these rights, Sobinco NV will comply with this within one (1) month of receiving the request. The request may be sent via registered mail or via email to privacy@sobinco.com.

6.4 Right to data portability

The User has the right to obtain the personal data provided to Sobinco NV in a structured, standard and machine-readable format. In addition, the User has the right to transfer these personal data to another controller if the processing of the personal data is based solely on consent obtained from the User. 
If the User wishes to exercise this right, Sobinco NV will comply with this within one (1) month of receiving the request. The request may be sent via registered mail or via email to privacy@sobinco.com.

6.5 Right to withdraw my consent/right to file a complaint

The User has the right to withdraw his or her consent at any time. Withdrawal of consent does not affect the lawfulness of processing based on the consent obtained before its withdrawal. In addition, the User has the right to file a complaint regarding the processing of his or her personal data by Sobinco NV with the Belgian Commission for the Protection of Privacy. 
If the User wishes to exercise this right, Sobinco NV will comply with this within one (1) month of receiving the request. The request may be sent via registered mail or via email to privacy@sobinco.com.
